4. Apex Name and Branding

The names “Apex Shipping Containers,” “Apex Shipping Containers LLC,” associated logos, designs, slogans, and other brand identifiers are proprietary business assets.

You may not use any Apex name, logo, branding, or confusingly similar identifier in a manner that could mislead customers, create confusion, redirect business, or suggest sponsorship, approval, affiliation, or endorsement without written authorization.

Nothing on this website grants any license to use Apex Shipping Containers LLC trademarks, service marks, trade names, logos, or branding.

5. Photographs and Project Images

Photographs and videos displayed on this website may depict containers, trucks, trailers, delivery locations, customer properties, jobsites, equipment, or completed projects.

Suspected copying, impersonation, misuse, or infringement may be reported to:

Apex Shipping Containers LLC

Apex Shipping Containers LLC reserves the right to investigate suspected unauthorized use and take appropriate action.

Depending on the circumstances, enforcement may include:

  • Requesting immediate removal of the material
  • Submitting takedown notices to website hosts, platforms, search engines, or social-media services
  • Contacting advertisers, payment processors, marketplaces, or service providers associated with the unauthorized content
  • Seeking injunctive relief
  • Seeking available damages, costs, and attorney fees
  • Pursuing any other remedies available under applicable law

Failure to enforce a provision on one occasion does not waive the right to enforce it later.

9. Accuracy of Website Information

Apex Shipping Containers LLC works to provide honest and accurate information. However, container availability, condition, color, specifications, pricing, taxes, delivery costs, timelines, routes, and service areas may change.

Website information is provided for general informational purposes and does not constitute a binding quote, guarantee, warranty, or offer unless confirmed in a separate written agreement issued by Apex Shipping Containers LLC.

Photographs may represent previously available inventory or examples of container conditions. Actual containers may vary.

10. Quotes, Sales, Rentals, and Deliveries

Website use does not create a customer relationship, reservation, purchase agreement, rental agreement, delivery agreement, or other binding transaction.

Container purchases, rentals, rent-to-own arrangements, transportation services, site-access requirements, placement instructions, payment terms, and delivery obligations are governed by the specific written quote, invoice, contract, or rental agreement applicable to that transaction.

If these Website Terms conflict with a signed transaction agreement, the signed transaction agreement controls regarding that transaction.

11. Third-Party Websites and Services

This website may contain links to third-party websites, payment providers, social-media platforms, maps, manufacturers, or other outside services.

Apex Shipping Containers LLC does not control and is not responsible for third-party content, privacy practices, security, availability, representations, or terms.

A link does not necessarily mean that Apex Shipping Containers LLC endorses or guarantees the third party.

12. Disclaimer of Warranties

To the fullest extent permitted by law, this website and its content are provided on an “as available” and “as is” basis.

Apex Shipping Containers LLC does not warrant that the website will always be uninterrupted, error-free, secure, accurate, or free from harmful components.

Nothing on this website should replace an onsite evaluation or a customer’s responsibility to verify access, measurements, permits, property conditions, zoning, utility locations, ground stability, and placement requirements.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Apex Shipping Containers LLC will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from or connected with the use of, inability to use, or reliance upon this website or its content.

This limitation does not exclude liability that cannot legally be limited or excluded.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Apex Shipping Containers LLC and its owners, employees, contractors, and representatives from claims, losses, liabilities, damages, expenses, and reasonable attorney fees arising from:

Impersonation, Reviews, and Unauthorized Websites

No person or organization may use the Apex Shipping Containers name, Apex Shipping Containers LLC name, logos, branding, photographs, contact information, customer testimonials, reviews, ratings, project examples, or other identifying materials to impersonate Apex Shipping Containers LLC or create a misleading appearance of affiliation.

Without prior written authorization, you may not:

  • Use Apex Shipping Containers branding in connection with fraud, phishing, payment collection, customer diversion, lead generation, advertising, or the sale or rental of containers or transportation services

Any such use is unauthorized and may constitute trademark infringement, false designation of origin, unfair competition, impersonation, copyright infringement, fraud, or a violation of applicable platform policies and laws.

Apex Shipping Containers LLC reserves the right to report unauthorized activity to website hosts, domain registrars, search engines, advertising platforms, social-media platforms, payment processors, law-enforcement agencies, consumer-protection authorities, and other appropriate parties.

Nothing in these Terms claims ownership of the independent copyright held by the original author of a customer review. However, reviews and testimonials may not be used deceptively, attributed to the wrong business, or presented in a manner that falsely implies affiliation with or endorsement by Apex Shipping Containers LLC.

Return and Refund Policy

Cancellation, Return, and Refund Policy

Effective Date: August 3, 2026

This Cancellation, Return, and Refund Policy applies to shipping containers, delivery services, rentals, accessories, special orders, and other products or services provided by Apex Shipping Containers LLC.

By approving a quote, signing an agreement, submitting payment, or accepting delivery, the customer acknowledges and agrees to this policy.

1. Container Sales Are Generally Final

Because shipping containers are large, heavy, costly to transport, and frequently sourced or scheduled for a specific customer, all container sales are final after the container has been inspected, accepted, and unloaded at the delivery location.

A container cannot be returned merely because the customer:

  • Changes their mind
  • No longer needs the container
  • Finds a lower price elsewhere
  • Dislikes ordinary cosmetic wear that was disclosed or reasonably expected
  • Failed to verify property restrictions, permits, measurements, access, or placement requirements
  • Selected the wrong size, condition, color, or container type
  • Is dissatisfied with the container’s placement after directing or approving that placement

Any exception must be approved in writing by Apex Shipping Containers LLC.

2. Customer Inspection Before Unloading

Customers should inspect the container before it is unloaded whenever reasonably possible.

The customer must notify the driver immediately if the container:

  • Is materially different from the container described in the written quote or invoice
  • Is the wrong size or type
  • Has undisclosed material damage
  • Does not satisfy a specifically stated written condition standard
  • Is not wind and watertight or cargo-worthy when it was expressly sold as such

The customer should not approve unloading or placement if the container is materially different from what was promised.

Acceptance of delivery and authorization to unload generally confirms that the container is acceptable based on the condition reasonably visible at delivery.

3. Used Container Condition

Used shipping containers are sold in used condition and may contain:

  • Dents, dings, scratches, and surface rust
  • Welded patches or previous repairs
  • Faded, mismatched, or marked paint
  • Shipping labels, decals, numbers, or markings
  • Floor stains, scratches, gouges, or previous cargo wear
  • Stiff doors, replaced hardware, or ordinary operational wear
  • Cosmetic differences from photographs used as general examples

These normal characteristics are not considered defects when they are consistent with the condition grade represented to the customer.

Unless a specific container number is identified in writing, website photographs and advertising photographs may be representative examples rather than photographs of the exact container delivered.

4. One-Trip Container Condition

One-trip containers are not represented as flawless or factory-perfect.

A one-trip container has generally completed at least one international shipping trip and may have minor dents, scratches, handling marks, paint imperfections, floor marks, decals, or other cosmetic wear caused by shipping and handling.

Normal cosmetic imperfections do not qualify the container for a return or refund.

5. Incorrect or Materially Misrepresented Containers

If Apex Shipping Containers LLC delivers the wrong container or materially misrepresents its size, type, or stated condition, the customer must notify Apex as soon as the issue is discovered.

Apex may, depending on the circumstances:

  • Correct the issue
  • Repair the container
  • Replace the container with a reasonably comparable unit
  • Offer an agreed price adjustment
  • Cancel the sale and issue an appropriate refund

Apex will determine the appropriate resolution after reviewing photographs, delivery records, written communications, and the condition of the container.

If the problem was caused by Apex, the customer will not be charged an additional delivery fee to correct the problem.

6. Problems Discovered After Delivery

Visible damage, condition disputes, or incorrect-container claims should be reported immediately and no later than 24 hours after delivery.

A concealed issue that could not reasonably be identified during delivery should be reported within seven calendar days after delivery.

Reports must include:

  • The customer’s name
  • Delivery address
  • Delivery date
  • Container number, when available
  • A description of the issue
  • Clear photographs or video showing the issue

Failure to report an issue within these timeframes may limit Apex’s ability to verify or correct the problem.

These reporting periods do not eliminate any rights that cannot legally be waived.

7. Cancellations Before Delivery

A cancellation request must be made directly to Apex Shipping Containers LLC.

Before a Container Is Purchased, Reserved, or Dispatched

Apex may approve cancellation without charge if no container has been purchased or reserved, no delivery has been scheduled or dispatched, and no outside costs have been incurred.

After a Container Is Purchased or Reserved

If Apex has purchased, reserved, transferred, modified, or otherwise committed to a container specifically for the customer, the customer may be responsible for:

  • Nonrefundable supplier or yard charges
  • Reservation or release fees
  • Transportation or repositioning costs
  • Modification or preparation costs
  • Administrative or payment-processing costs that cannot be recovered
  • Other actual expenses incurred for the order

Any remaining refundable balance will be returned after these costs are deducted.

After Dispatch

Once the truck and trailer have departed for pickup or delivery, the delivery charge and any applicable attempted-delivery expenses are nonrefundable.

8. Deposits and Advance Payments

Unless otherwise stated in writing, a deposit is applied toward the customer’s purchase, rental, modification, or delivery charges.

A deposit may become nonrefundable after Apex:

  • Purchases or reserves the container
  • Receives a container release number
  • Schedules or begins transportation
  • Orders materials or accessories
  • Performs modifications or preparation
  • Incurs third-party expenses for the customer’s order

Apex will not keep more than the deposit or payment amount reasonably necessary to cover the customer’s agreed obligations and actual nonrecoverable costs, unless a separate written agreement states otherwise.

9. Special Orders and Modified Containers

Special-order, custom-sourced, painted, modified, repaired, fabricated, or customer-specific containers are nonreturnable and nonrefundable once work, purchasing, or sourcing begins.

This includes containers with:

  • Custom paint
  • Doors, windows, vents, or electrical work
  • Lockboxes or specialized hardware
  • Customer-requested repairs
  • Custom fabrication
  • A requested color, size, location, or condition
  • Other customer-specific modifications

If Apex cannot complete the agreed work, Apex will provide an appropriate refund for work or products that were paid for but not provided.

10. Delivery and Placement Charges

Delivery, transportation, pickup, relocation, tilt-bed service, waiting time, and placement charges are nonrefundable once the applicable service has been performed.

The customer is responsible for providing:

  • Safe and legal site access
  • Adequate overhead, width, height, and turning clearance
  • Stable and reasonably level ground
  • A clear placement area
  • Accurate placement instructions
  • Permission from the property owner
  • Required permits, zoning approval, or association approval
  • Disclosure of underground utilities, septic systems, soft ground, and other hazards

If delivery cannot be completed because the property is unsafe, inaccessible, obstructed, too soft, too steep, too narrow, or otherwise unsuitable, the customer remains responsible for the attempted delivery and any additional transportation, storage, waiting, redelivery, or recovery costs.

A failed delivery caused by Apex’s equipment or scheduling error will be handled without charging the customer an additional delivery fee.

11. Customer-Requested Placement

The customer or the customer’s authorized representative is responsible for selecting and approving the container placement location.

Once placement is approved and the container is unloaded, repositioning or relocating the container is considered a new service and may require an additional charge.

Refunds will not be issued because the container settles, shifts, becomes difficult to open, or experiences drainage problems due to ground conditions after placement, unless the issue was directly caused by Apex’s failure to perform the expressly agreed service.

12. Refusal of Delivery

A customer may refuse delivery before unloading if the container is materially different from what Apex agreed to provide.

If the container conforms to the written order and the customer refuses it because of a change of mind, insufficient space, property-access problems, permit problems, color preference, ordinary cosmetic wear, or another matter outside Apex’s control, the customer remains responsible for:

  • The original delivery charge
  • Return transportation
  • Yard or storage charges
  • Supplier charges
  • Other actual costs caused by the refusal

13. Rentals

Container rentals are governed by the customer’s rental agreement.

Unless the rental agreement expressly states otherwise:

  • Rent already earned or paid for a started rental period is nonrefundable
  • Rental periods are not prorated
  • Delivery and retrieval charges are nonrefundable after the service is performed
  • Rent continues until the container is physically retrieved
  • Early termination does not eliminate the minimum rental commitment
  • Failed retrieval or inaccessible-container charges remain due

Security deposits, when applicable, will be handled according to the rental agreement after deducting unpaid rent, damage, cleaning, disposal, recovery, transportation, or other authorized charges.

14. Accessories and Separate Products

Unused, standard accessories that have not been installed may be eligible for return only when Apex approves the return in writing.

Returned accessories must be:

  • Unused
  • Undamaged
  • Complete
  • In resalable condition
  • Returned within 14 calendar days after receipt

Original delivery, installation, removal, payment-processing, and return-transportation charges are not refundable.

Custom, installed, altered, or special-order accessories are not returnable.

15. Refund Processing

Approved refunds will generally be issued through the original payment method when reasonably possible.

Refund timing may depend on the payment processor or financial institution. Apex is not responsible for delays caused by a bank, card provider, or payment platform after Apex submits the refund.

Amounts legally required to be refunded will be processed within the timeframe required by applicable law.

16. Chargebacks and Payment Disputes

Customers should contact Apex Shipping Containers LLC before initiating a chargeback or payment dispute so the issue can be reviewed and, when appropriate, corrected.

A chargeback does not cancel a valid contract or eliminate amounts properly owed for a container, delivery, rental, damage, failed delivery, or other completed service.

Apex may provide signed agreements, photographs, text messages, emails, invoices, delivery records, GPS information, and other transaction evidence to the payment provider in response to a dispute.

Nothing in this section limits a customer’s lawful right to challenge an unauthorized or incorrect charge.

17. No Automatic Satisfaction Guarantee

Apex Shipping Containers LLC does not offer an unrestricted satisfaction guarantee, trial period, or automatic right to return a container.

Apex stands behind its written representations and will make a good-faith effort to correct legitimate problems. However, refunds and replacements are based on the written agreement, the container’s represented condition, the facts of the delivery, and applicable law.

18. Exceptions Required by Law

Nothing in this policy limits or eliminates any cancellation, refund, warranty, or consumer right that cannot legally be waived.

Transactions covered by a legally required cancellation period will be handled according to the applicable law and required cancellation notice.
